Unbundled services are a variety of services that allow you to represent yourself in your case. These could be offering legal advice, writing pleadings/court documents, negotiating with opposing parties, emails, and letters. It would also include coaching and writing arguments for you to present in court.
A benefit of these services is that it keeps the costs lower, allowing you to pay for only the services you need.
In other words, it provides you with an advocate who assists you behind the scenes while you stay in the driver’s seat and maintain independence in your case.
The most simple answer is so you and not a court can dictate what happens to all of your belongings after you pass away. If you don’t prepare an estate plan, your most valued possessions may end up going to someone you never wanted to have them.
Sometimes, however, your goal might be to avoid your loved ones having to go through a lengthy court process. While, wills still have to go through the probate process, there are a variety of creative planning options you can use to avoid probate and have the process be much quicker for your loved ones. This can be accomplished through a pour-over will which “pours” everything left at the time of your death into a trust to be distributed according to the terms of the trust. It may also just simply be accomplished through putting everything in a trust before you pass away. Finally, it could also be accomplished through transfer on death deeds, and payable on death designations.
In addition, planning for incapacity is vital. In the event that you become incapacitated and unable to manage your financial affairs and/or healthcare decisions, you will want someone you feel safe with deciding those things, to jump right in. What you probably don’t want to happen is the alternative: someone being appointed by the court, after going through a cumbersome process, to handle your affairs. This may not always be the person you would appoint in a durable power of attorney.
We also do faith based estate planning, which has its own important considerations, that other types of planning don’t.
While we can help with almost any type of estate planning to help fit your needs, we do not assist with high net-worth estate planning currently in the $12/13 million plus range (federal exemption limit for estate tax) because this often has specific tax considerations.
We are also able to help with opening and closing probate with some advice as needed in between.
We offer pay as you go, flat fee methods, as well as sliding scale options if needed. We offer pay as you go because it is often more affordable for people than requiring thousands of dollars up front.
Many of our estate planning services can be done on a flat fee scale as well, depending on the type of documents you need to be completed.
