These are variety of services that allow for an attorney to guide you through your case while you maintain control of the case. These could be offering legal advice, writing pleadings/court documents, sending draft emails for you to send or emails, letters. It would also include coaching and writing arguments for you to present in court.
A benefit of these services is it keeps the costs lower in your case and allows for you to only pay for what you need when you need it while you maintain control of the reigns of your case.
In other words, it gives you an advocate helping you behind the scenes while you stay in the driver’s seat and keep your independence in the case.
Often times there is a creative solution that would be acceptable to both parties but it just has not been discovered yet. Sometimes attorneys do not look for this solution because they are used to litigation/traditional practices of resolving cases or because litigation often involves higher attorneys fees.
Collaborative can mean a variety of things. There are traditional collaborative practices, which typically involve your lawyer, the other party’s lawyer, a mental health professional neutral and a financial neutral. This team meets several times and attempts to resolve family issues during those meetings. If no resolution is reached, a participation agreement has already been signed which forbids those collaborative attorneys from going on to represent any of same team members in litigation. This agreement helps to create a safe container for both parties to speak freely when trying to resolve issues.
Collaborative law can also be used in a less formal way by negotiating and/or mediating instead of jumping straight to litigation.
There are variety of reasons to try to resolve family issues outside of court but three biggest are:
1. It tends to be more affordable and flexible of a process.
2. The parties get to work together to create solutions that work best for their life instead of living it all to a third-party (judge) who may or may not decide a solution that will ultimately work best for both parties.
3. Potentially harmful statements are not put in publicly filed documents for all to see nor is the process played out in a public forum/courtroom for anyone to observe. The children , if any are involved, do not have to worry about personal information about their childhood being displayed in court documents forever, and they get to see their parents work together in a healthy co-parenting relationship.
